Hustling a Warranty?

The plaintiff claims he purchased a car and warranty from the defendant, and sure enough the car started to run badly. After the issues began, he tried contacting the defendant on multiple occasions for repair, but his calls allegedly were ignored. He is suing for the cost of the warranty. The defendant claims the plaintiff never brought the car into the warranty company for an inspection to make sure there were no pre-existing conditions
